Kochi, October 15 (IENews) Bishop Franco Mulakkal has been granted conditional bail by the Kerala High court today.
The accused clergyman was arrested on September 21st on accusations of raping, sodomising and confining as 44-year old nun between 2014 and 2016.
The conditions imposed by the court for granting bail includes not to enter Kerala, surrender his passport, and appear before the investigating officer once in two weeks.
Senior counsel P Vijayabanu appearing for the Bishop, relied on the deteriorating health condition of the accused and his temporary relief from pastoral duties as grounds to warrant a bail.
The senior counsel also argued that the circumstances pointed out by prosecution to oppose his first plea do not exist now.
Statements of material witnesses have already been recorded under Section 164 CrPC. Therefore, prosecution’s apprehension that witnesses may be influenced doesn’t have much significance at this stage, the counsel had submitted.
